Terms of Service

Welcome to Planetary Talent, where the future of hiring is already here. These Terms of Service ("Terms") outline the conditions under which you engage with our talent placement services, including Direct Hire and Monthly Talent Subscriptions. By using our services, you agree to these Terms. If you don't agree, please step away from the launchpad.

1. Introduction

Planetary Talent exists to make Earth's most talented workforce accessible to growing companies—fast, efficiently, and without the usual intergalactic red tape. Our services are built to connect companies with top-tier global talent while ensuring compliance, transparency, and ease of engagement.

These Terms govern your relationship with Planetary Talent, covering invoicing, guarantees, and subscription structures. Strap in and read on.

2. Services

Planetary Talent provides customers with access to remote workers (the "Talent" or individually, the "Service Provider") from various geographical locations, including outside of the United States.

Our services (“Services”) may include:

  • Recruiting, screening, interviewing, and presenting potential Talent to perform the desired work for Customer for the requested term.
  • Working with the Talent Manager to recruit Talent, ensuring the Talent is compensated at or above market wage and complies with all laws in their respective country.
  • Ensuring Talent located in the United States is legally authorized to work in the United States.
  • Requiring the Talent to acknowledge and agree in writing that any work performed for any Customer shall be owned solely by the Customer.
  • Providing accountability monitoring and analytics on the Talent’s productivity using AI and other tools.
  • Providing Customer with reports pertaining to the Talent as may be reasonably requested.

3. Direct Hire Terms

  1. Matchmaking Fee:
    • If you choose to hire talent directly without using our employment services, you owe a matchmaking fee equivalent to two months of the talent’s compensation, payable upfront.
    • You won’t receive the talent’s contact details for onboarding until this payment is made in full. No credits, no exceptions.
  2. 60-Day Replacement Guarantee:
    • While the matchmaking fee and any completed work are non-refundable, Planetary Talent will replace the talent within the first 30 days at no cost to ensure customer satisfaction.
    • After the first 30 days, Planetary Talent will replace the talent within the first 60 days for 50% of the matchmaking fee of the new talent.

4. Monthly Talent Subscription Terms

  1. Subscription Agreement:
    • Our Monthly Talent Subscription is a month-to-month agreement that allows you to subscribe to a role with an agreed-upon talent for as long as both parties wish to continue the engagement.
  2. Matchmaking Fee:
    • Once you select talent, we issue an offer letter. Once signed, a matchmaking fee is invoiced and must be paid immediately.
  3. Talent Start Dates:
    • Talent starts on either the 1st or 15th of the month, depending on their availability and any notice period they must serve in their current role.
  4. Billing Schedule:
    • Monthly invoices are auto-billed upfront like a SaaS subscription, ensuring continuous service without interruption.
    • Payments occur on the 1st or 15th of each month, depending on the talent’s start date.
  5. Transparent Billing:
    • Our subscription prices are all-inclusive, covering country fees, administrative costs, employment fees, and add-ons.
    • A breakdown of talent pay is available in our app, or you can request a detailed report from customer support.
  6. 90-Day Replacement Guarantee:
    • The matchmaking fee and any work completed by the talent are non-refundable.
    • Within the first 90 days, we’ll replace talent as many times as needed at no additional matching cost. However, talent rates may vary.
  7. Talent Departure Policy:
    • If a talent chooses to leave at any time, we will source a replacement without an additional matchmaking fee. Talent rates may vary.
  8. Post-90-Day Replacement Policy:
    • If you choose to terminate a talent after 90 days but want to continue the role subscription, we will find a replacement.
    • A new matchmaking fee will apply to onboard the replacement talent.
    • If you terminate a talent after 90 days, you owe an additional month of severance unless you provide a 30-day notice to the talent.

5. Use of AI & Data Privacy

  1. AI-Assisted Hiring & Analytics:
    • Clients consent to the use of AI for talent matching, performance monitoring, and recruitment process optimization.
    • AI-generated insights are supplemental and do not replace human evaluation in hiring decisions.
  2. Training AI on Work Performed:
    • Customers acknowledge and agree that the Talent may be recorded while performing services for the Customer, and these recordings can be used by Planetary Talent for AI training purposes.

6. Intellectual Property

  1. Ownership of Work Product:
    • Any copyrightable works, inventions, patents, or discoveries created by the Talent while performing services for a Customer shall be solely owned by the Customer.
    • Talent is required to sign an agreement assigning all intellectual property rights in their work product to the Customer.
  2. Planetary Talent’s Intellectual Property:
    • Any proprietary technology, tools, AI systems, or methodologies developed by Planetary Talent remain the exclusive property of Planetary Talent and are not transferred to the Customer.

7. Force Majeure

  1. Unforeseen Events:
    • Planetary Talent is not liable for any failure or delay in fulfilling its obligations due to circumstances beyond its reasonable control, including but not limited to:
      • Acts of God (e.g., natural disasters, pandemics, or extreme weather events)
      • Government orders, regulations, or law changes
      • Cyberattacks, internet disruptions, or technological failures
      • Strikes, labor shortages, or industry-wide disruptions
  2. Resolution Efforts:
    • In the event of a force majeure event, Planetary Talent will make reasonable efforts to resume services as soon as possible and keep clients informed of expected timeframes for resolution.
